Allegations for co-owner of the Bitmarket exchange, Marcin A.

Marcin A., co-owner of the Bitmarket exchange operator, heard accusations of unfavorable disposal of property exceeding PLN 22 million. Only after questioning by the prosecutor will a decision be made whether he will spend the time until the end of the trial, and what form of restriction of liberty will be applied by law enforcement agencies. The second partner - Tobiasz Niemiro - committed suicide at the end of July this year.

Let's remind: Bitmarket, one of the best-known Polish cryptocurrency exchanges, suspended its operations overnight. First, the site published information that it has technical problems and login problems may occur, and then the bitmarket.pl domain has completely stopped working.

Earlier, from 2014, the Bitmarket cryptocurrency exchange was operating through a company registered in Seychelles and operator Kvadratco Services Limited from the United Kingdom. As if the countries involved in this activity were not enough, the Internet domain was registered by a company from Estonia. In 2017, Marcin A. and Tobiasz Niemiro acquired domain rights. When they were supposed to take over the deposits, the stock exchange closed.

According to unofficial data, the company's accounts were to have the equivalent of approximately PLN 100-500 million in cryptocurrencies. 5 thous. Were active users of the stock exchange, but registered customers were about 10 times more, and it is known that there are a lot of investors who bought Bitcoiny and intend to keep them for a long time. It is known that only on Facebook itself, to the group "Bitmarket - victims" 3,8 thousand registered people.

Law enforcement authorities took care of the matter quickly. The partners involved in managing the Bitmarket exchange began to bid on who was more injured.

At the end of July this year, it turned out that one of them - Tobias Niemiro - committed suicide. He was found in a forest near Olsztyn with a bullet wound to the head.

"We exclude the participation of third parties" - Arkadiusz Szulc, the District Prosecutor of the Olsztyn-North Prosecutor's Office, under whose supervision the police are conducting the investigation, stated unequivocally.

Allegations for Marcin A.

On Thursday, 12.09.2019 District Prosecutor's Office in Suwałki brought charges against his partner Marcin A. The investigation leads the Department to Fight Cyber-Crime of the Provincial Police Headquarters in Olsztyn. As part of it, it was established that from May 2015 the company's managers were misleading customers. This would directly affect a loss of a minimum of PLN 2,3 Bitcoin. Their value is around 100 million PLN. Investigators unofficially emphasize that the case is developmental and detention and extension of charges are not excluded. However, the prosecutor's findings can already impress.

At least 525 injured Bitmarket clients

The investigators' statement reads:

"(...) he was charged with a crime consisting in the fact that from May 2015  do  7 July 2019 in Olsztyn and other cities, acting on behalf of the Internet  on behalf of companies based in London and the Seychelles  jointly and in consultation with other persons, on  the virtual currency exchange market operated under the bitmarket.pl domain, misleading its users 525 led them to an unfavorable disposition of property with a total value of PLN 22.661.288. This act is qualified  with art. 286 par. 1 of the Penal Code in connection with with art. 294 paragraph 1 of the Penal Code in connection with with art. 12 par. 1 of the Penal Code ".

However, this is not all. The prosecutor's office also accuses Marcin A. that selling shares in the company for 120 thousand. PLN, he was to mislead the contractor by informing him that the company did not have any obligations, while it was already known then that the outstanding debts amounted to 22 million 661 thous. 288 PLN.

The businessman faces a penalty of up to 10 years in prison.
