Terms of Use

These Regulations define the conditions, rules and manner of providing Services electronically via the Forex Club website.

I. PRELIMINARY PROVISIONS

Unless otherwise indicated, definitions used in this document mean:

Terms of Use – this document regulating the rules of using the Website;
Service – Forex Club website available at the main address https://forexclub.pl and subdomains, constituting an IT and information platform, consisting of a number of elements specific to internet portals;
The service provider – the managing entity and at the same time the Website Administrator, who runs it and provides the Service, which is OnTrade Sp. z o. o. with its registered office in Kraków, ul. st. Filipa 23/3, entered into the National Court Register under the number 0000383806, kept by the District Court for Kraków - Śródmieście in Kraków, 6342779923th Commercial Division of the National Court Register, NIP: 241913018, REGON: XNUMX, which is also the owner of the Website;
Service – a service provided electronically by the Service Provider, consisting in making content available at the User's individual request (by displaying a page with a specific URL address), enabling Users to exchange information, providing the Service Provider's IT resources in order to enable Registered Users to post their opinions on a given topic and enabling Users to use from IT mechanisms that allow you to search and display data saved on the Website;
The Client – a natural person with full legal capacity, a legal person or an organizational unit without legal personality, which the law grants legal capacity;
User – the Service Recipient using the Website;
Registered User – a Service Recipient who has registered on the Website and has his unique Login secured with a password;
Login – individual and unique name of the User on the Website, which was adopted by him at the stage of setting up (registering) an Account on the Website;
Account – a place available for a given User after logging in (entering the Login and password) on the Website, thanks to which the User can perform operations related to the functioning of the Website and related Services;
Forum – one of the Related Services, part of the Website in the form of a discussion group, within which Registered Users exchange information and opinions on topics related to the broadly understood capital market;
Shop – A related service operating within the Forum, available at https://forum.forexclub.pl;
Products – digital content, made available to the Service Recipient via the Website (in intangible form) under the conditions set out in the Agreement and these Regulations;
Order – declaration of will of the Service Recipient submitted via the Website, leading to the conclusion of a sales contract or a contract for the provision of services using the order form (Basket, i.e. without the simultaneous presence of the parties), preceded by the selection of the number of Products that are available in the Store or the Website and the selection of the method payments;
Agreement – a contract concluded between the Service Provider and the Service Recipient regarding the provision of a selected category of Services or a contract for the sale of a specific Product or the provision of a specific Service offered through the Store;
Cart – the order form available on the Website, through which the Service Recipient places an Order in the Store and selects the payment method;
payment system – a service provided by a third party that allows you to make payments on the Website;

II. GENERAL PROVISIONS

These Regulations define the rules for using the Website. Specific regulations regarding individual related services, if applicable, have been made available on the websites through which they are made available.
Before using the functions of the Website, you should carefully read the provisions of the Regulations. The User is obliged to comply with generally applicable laws, the Regulations and the rules of netiquette.
The User may stop using the Website and/or delete their Account from the Website at any time.
User registration on the Website is voluntary and free of charge and takes place by performing all activities covered by the registration procedure available at https://forum.forexclub.pl/register/
For the correct and full use of the Service, the following is required:

Internet connection
any web browser that displays websites in accordance with the standards and provisions of the W3C Consortium and supports websites made available in HTML5,
JavaScript enabled,
cookies enabled.

The technical conditions for using the Website and related services are crucial for their proper functioning, as well as the security of the User's data saved on the Website Account.
The User should comply with the conditions and guidelines indicated by the Service Provider, and any actions or omissions of the User inconsistent with the Service Provider's recommendations (intentional or unintentional) are made at his sole responsibility and risk.

III. TERMS OF PUBLICATION

The Registered User has the right to post his own content on the Website, in particular as a comment to an article or a post on the Forum, in accordance with the subject matter to which they relate.
It is forbidden to post offensive or defamatory content on the Website towards other Users, the Service Provider, persons, companies and/or other third parties.
It is forbidden to post text, graphic, audiovisual, scripts, programs and/or other works on the Website without having the appropriate license or for which the owner of the property rights has not consented to free publication.
It is forbidden to post on the Website content that is vulgar, pornographic, erotic and inconsistent with Polish and European law, as well as links to websites containing such content.
It is forbidden to place on the Website scripts and programs that overload the server, illegal software, software used to breach security and other similar activities, as well as links to websites containing such materials.
It is forbidden to post marketing content and advertising other commercial websites, products, services or commercial websites on the Website without the express consent of the Service Provider.

IV. STORE

The Service Provider provides some of the Services related to payment in the Store (Product in a paid subscription).
The Service Recipient, after logging in to his Account on the Website, has the option of placing an Order via the Store. The Customer who does not have an Account on the Website is obliged to register before placing the first order.
The conclusion of the Agreement with the Service Recipient takes place at the moment of placing the Order by him.
The price of the ordered Product is visible on the Store's subpage next to its description, and is given in PLN (Polish zlotys) and includes all components, including VAT.
To place an order in the online store, it is necessary to accept these Regulations.
All operations in the Store (including Orders) take place using an ICT system that provides processing, storage, sending and receiving data, and the website has an SSL certificate - a secure communication encryption protocol.
Placing Orders in the Online Store is possible 24 hours a day, all days of the year.
In the event of exceptional circumstances or inability to complete the Order, the Service Provider will immediately contact the Customer to determine the further procedure, including setting a different date for its implementation.
The Service Provider reserves the right to refuse to use the Store or to limit access to some or all of the Store's resources with immediate effect when the latter:

when filling in the Basket (order form) in the Store, provided untrue, outdated or incomplete data, misleading or infringing the rights of third parties,
has committed other acts that will be considered by the Service Provider as inconsistent with applicable law or the Regulations.

V. ON-SITE PAYMENTS

Payments made by Users for their use of the Services offered on the Website are made via the PayByLink payment system (https://paybylink.pl), whose operator is Payment Systems, al. Jana Pawła II, 00-133 Warsaw, NIP: 1182105129, REGON: 360726494.
Within the indicated Payment System, the following payment methods are available:

electronic payments by automatic transfers (including BLIK),
electronic payments by traditional transfers,
credit cards.

Redirection to the indicated Payment System takes place by clicking on the appropriate link on the Website.

VI. PRIVACY POLICY

The Service Provider informs that when using the Website, short text information called "cookies" is saved on the User's computer (hereinafter: "cookies") or other technologies are used. The use of "cookies" is necessary for the proper provision of Services on the Website, in particular in order to personalize the content made available to the User. Cookies also contain information necessary for the proper functioning of the Website, in particular those requiring authorization.

VII. COPYRIGHT

The Service Provider is the owner of the Website and copyrights to the website.
The data posted on the Website are protected by copyright belonging to the service provider, to companies, institutions and/or third parties not related in any way to the Service Provider, and are used on the basis of licenses obtained or based on a free license.
Pursuant to the Act of February 4, 1994 on copyright, it is forbidden to use, copy, reproduce in any form articles, descriptions, photos and any other content, graphic, video or audio materials on the Website without written consent or express consent provided electronically. their legal owner.
Pursuant to the Act of February 4, 1994 on copyright, simple press releases, understood as information without comment and evaluation by their author, are not protected. It is therefore possible to use such information from the texts posted on the website, but without copying all or part of the articles, unless it has been marked in the material made available on the website.

VIII. CHANGES TO THE REGULATIONS

All provisions of the Regulations may be unilaterally changed by the Service Provider at any time, without giving reasons.
In the event of a change to the Regulations, its provisions enter into force immediately after its publication for Users who do not have an Account on the Website.
In the event of a change to the Regulations, its provisions enter into force with a 7-day transition period for Registered Users who have an Account on the Website created before the change of the Regulations.
It is considered that every User who continues to use the Website after the change of the Regulations accepts it in its entirety.

IX. FINAL PROVISIONS

The Service Provider will make every effort to ensure that the Website and Related Services are offered continuously. However, it bears no responsibility for disruptions caused by force majeure or unauthorized interference by Users or third parties or the operation of external automatic programs disrupting the functioning of services.
The Service Provider reserves the right to change any information placed on the Website at a time selected by the Service Provider, without the need to notify Users using the Website in advance.
The Service Provider reserves the right to temporarily, completely or partially disable the Website in order to improve it, add, update Related Services or carry out maintenance, without prior notification to Users (including Registered Users).
The Service Provider is not responsible in any way for the content provided and published on the Website by Users, for their truthfulness, reliability, authenticity or legal defects.
